Affiliate Program Terms & Conditions (Everflow)

This Affiliate Program Agreement (the "Agreement") is entered into by and between LEXIVANTA LIMITED ("Company", "we", "us", or "our"), a company incorporated in the Republic of Cyprus, and you ("Affiliate", "you", or "your"), who wish to participate in our affiliate program managed via the Everflow tracking platform.

By registering as an Affiliate in our tracking network, you agree to be bound by the terms and conditions set forth in this Agreement, as well as our general Terms of Service and Privacy Notice.

1. Enrollment and Participation

1.1 Account Approval: All affiliate applications are subject to manual review by LEXIVANTA LIMITED. We reserve the right to reject or suspend any account that does not meet our quality standards.

1.2 Traffic Sources: Affiliates must disclose their primary traffic sources within the platform interface. Any significant change in traffic sources must be reported to our affiliate team.

2. Promotion and Creative Assets

2.1 Approved Creatives: You may only use marketing materials provided within the dashboard. Any custom-made creatives must be approved by LEXIVANTA LIMITED in writing before use.

2.2 Prohibited Methods: You shall not engage in:

  • Incentivized Traffic: Offering rewards or compensation to users for clicking or signing up.
  • Brand Bidding: Bidding on "WinkMe", "WinkMe.ai", or any variations in search engine marketing (SEM).
  • Cookie Stuffing: Using scripts to drop tracking cookies without a genuine user click.
  • Deceptive Advertising: Using misleading claims about our AI technology or service capabilities.

3. Commission and Tracking

3.1 Tracking Method: Commissions are tracked exclusively via the technical postbacks or pixel tracking provided by the platform. We are not liable for tracking discrepancies caused by incorrect implementation.

3.2 Validation: All conversions are subject to a quality validation period. Commissions for fraudulent, duplicate, or high-refund traffic will be voided at our sole discretion.

3.3 Payouts: Payouts are issued according to the cycle defined in your dashboard, provided you meet the minimum payout threshold.

4. Anti-Fraud Policy

4.1 Detection: We utilize advanced fraud detection tools to monitor traffic. If we detect suspicious activity (e.g., bot traffic or stolen credit cards), your account will be suspended immediately.

4.2 Clawbacks: We reserve the right to claw back commissions for any transactions that result in a chargeback or are identified as fraudulent up to 90 days after the conversion.

5. Termination

5.1 Termination at Will: Either party may terminate this Agreement at any time by providing notice via the platform or email.

5.2 Safety Violations: Any violation of our safety guidelines (e.g., promoting content involving minors) will result in immediate termination and forfeiture of all pending commissions.

6. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes shall be resolved by the competent courts of the Republic of Cyprus.
